Delimitation of Union Councils Rules 2022

NOTIFICATION

No. SOR(LG)8-15/2022.– In exercise of the powers conferred under section 202 of the Punjab Local Government Act 2022 (XXXIII of 2022), Governor of the Punjab is pleased to make the following rules:

1.         Short title and commencement.– (1) These rules may be cited as the Punjab Local Government (Delimitation of Union Councils) Rules 2022.

(2) They shall come into force at once.

2.         Definitions. (1) In the rules, unless the subject or context otherwise requires:

  1. “Act” means the Punjab Local Government Act 2022 (XXXIII of 2022);
  2. “delimitation authority” means an authority appointed under rule 7 of the rules;
  3. “delimitation committee” means a committee appointed under rule 3 of the rules;
  4. “Form” means form appended to the rules;
  5. “population” means the population of a local area in accordance with the preceding census provisionally or finally published under the General Statistics (Reorganization) Act, 2011 (XIV of 2011), whichever is later;
  6. “Provincial Election Commissioner” means the Provincial Election Commissioner, Punjab; and
  7. “rules” means the Punjab Local Government (Delimitation of Union Councils) Rules 2022.

(2) A word or expression used but not defined in the rules shall have the same meaning as is assigned to it under the Act.

3.         Appointment of delimitation committee.- (1) The Election Commission shall appoint a delimitation committee for each district from amongst the officers of the Election Commission, the Federal or the Provincial Government or autonomous body controlled by the Federal or Provincial Government.

(2) The delimitation committee shall delimit the Union Councils within the district in accordance with the provisions of the Elections Act, 2017, Act, rules and instructions issued by the Election Commission.

4.         Functions of the delimitation committee.- (1) The delimitation committee shall delimit the Union Councils in accordance with sections 10, 11 and 12 of the Act.

(2) The delimitation committee shall delimit the urban area in a district constituting the Metropolitan Corporation, defunct Municipal Corporation, defunct Municipal Committee, defunct Town Committee under the Punjab Local Government Act, 2019 (XIII of 2019) into urban Union Councils, with an average population of twenty-five thousand.

(3) The delimitation committee shall delimit rural area in a District Council into rural Union Councils, with an average population of twenty-five thousand.

(4) The delimitation committee shall delimit the Union Councils, as far as possible, equal in population among themselves. In case of variation, difference shall not be more than ten percent without breaking any revenue estate into two or more union councils in rural area and census block in urban area and If It exceeds the ten percent the delimitation committee shall record reasons for such variation:

Provided that revenue estate, as far as possible, may be kept intact while delimiting rural union council.

            (5) The local area of each Union Council shall be a territorial unit.

(6) The boundaries of a Rural Union Council shall not cross the limits of the respective tehsil in a district.

(7) The boundaries of Urban Union Council shall not cross the limits of the respective Metropolitan Corporation, defunct Municipal Corporation or Municipal ‘Committee or Town Committee constituted under the Punjab Local Government Act, 2019 (XIII of 2019), as the case may be.

5.         Assistance to the delimitation committee.- (1) Subject to the control of the Election Commission, the delimitation committee may require any person or officer in the district to perform such function or render such assistance as may be required for the purposes of delimitation of Union Councils under the Elections Act, 2017, the Act, rules and Instructions issued by the Election Commission.

            (2) The Deputy Commissioner shall facilitate the delimitation committee in whole process of delimitation and provide required details about the local area of each local government demarcated under section 7 of the Act.

            (3) The Deputy Commissioner shall provide all notifications of local areas showing notified population along with their census block codes and copies of authenticated maps of district showing the clear boundaries of Metropolitan Corporations, defunct Municipal Corporations, defunct Municipal Committees and defunct Town Committees demarcated under the Punjab Local Government Act, 2019 (XIII of 2019) along with their census block codes on the scale determined by the Election Commission and any other Information as may be required by the Delimitation Committee.

6.         Preliminary list of Union Councils. (1) The delimitation committee shall prepare preliminary lists of Urban Union Councils and Rural Union Councils on Form-I and specify the area proposed to be included in each Union Council within such period as may be determined by the Election Commission.

(2) The local areas of Urban Union Councils and Rural Union Councils shall be identified with a specific number:

Provided that for the purpose of delimitation, the delimitation committee shall assign the serial number to each Urban Union Council and Rural Union Council in a local area starting from 01 and so on for each local area in clock-wise manner.

(3) The delimitation committee shall, within the time fixed by the Election Commission, publish the preliminary lists of Urban Union Councils and Rural Union Councils in the manner as may be directed by the Election Commission Inviting objections on the preliminary list to be filed before the concerned delimitation authority.

(4) The preliminary lists of Union Councils shall be placed for public Inspection at notified places.

7.         Delimitation authority.- (1) The Election Commission shall- appoint a delimitation authority for each district for hearing and disposal of objections received under rule 8, from amongst its own officers or officers of the subordinate judiciary:

Provided that the officers of subordinate judiciary shall be appointed In consultation with the Chief Justice of the Lahore High Court, Lahore.

(2) The delimitation authority may summon a witness, hold Inquiry and record evidence for the purposes of deciding an objection on preliminary delimitation of Union Council:

Provided that the delimitation authority may require any person or authority in the district for its assistance for the disposal of objections filed.

8.         Manner of filing of objections on the preliminary delimitation.- (1) A voter of the Union Council may, within fifteen days from the date of the publication of preliminary list of Union Councils, file an objection on Form-II to the delimitation authority against the preliminary delimitation of the Union Council by affixing one hundred rupees court fee stamps and attaching a copy of his Computerized National Identity Card with the objection application.

(2) The person making the objection shall sign it and present it in person or through an agent authorized in writing.. The authorization shall be attested by the Oath Commissioner appointed under the Oaths Act, 1873 (X of 1873) or a Notary appointed under the Notaries Ordinance, 1961 (XIX of 1961).

            (3) A person filing objection may obtain a copy of map against payment of a printing fee of one thousand rupees per map, from the convener of the delimitation committee.

(4) The delimitation authority shall decide the objection filed under sub-rule (1) within thirty days from the date of publication of preliminary delimitation under sub-rule (3) of rule 6.

(5) A representative of the delimitation committee may assist the delimitation authority as and when required for the disposal of the objection filed against the preliminary delimitation of Union Council.

(6) If the delimitation authority fails to decide the objection within the time specified under sub-rule (4), the objection shall abate and the preliminary list of the Union Council shall, to the extent of such objection, become final.

(7) The delimitation authority shall as early as possible but not later than seven days after last day fixed for disposal of objections, communicate its decision to the delimitation committee.

            (8) The delimitation committee shall incorporate the decision of the delimitation authority received under sub-rule (7) In the preliminary list of Union Councils and prepare the final list of Urban Union Councils and Rural Union Councils on Form-III.

9.         Register of objections. The delimitation authority shallmaintain the record of objections in Form-IV.

10.       Final lists of Union Councils. The delimitation committee shall publish the final list of Urban Union Councils and Rural Union Councils as may be directed by the Election Commission and send a copy of the final list of Union Councils to the Provincial Election Commissioner for its publication in the official Gazette.

11.       Supply of copies etc. A person may obtain a copy of preliminary or final list of Union Councils published under rules 6 and 10 of the rules from the office of the District Election Commissioner on payment of fee at the rate of ten rupees per page in the shape of court fee stamps.

12.       Alteration In the programme for delimitation.– Notwithstanding anything contained in the rules, the Election Commission may, for reasons to be recorded in writing, alter, amend or rescind the timelines given for carrying out different activities given under the rules.

13.       Delimitation to remain valid for next elections.- (1) Notwithstanding anything contained in the rules, the final list of Union Councils shall remain valid till next census or any change in the number or limits of estates in any district or part of a district.

            (2) In case of change in the number or limits of estates in any district or part of a district, the Election Commission shall initiate the process of delimitation of the Union Councils under the rules to the extent of that district or part of district where change has been affected for the next elections of the Union Councils.
